GENERAL TERMS AND CONDITIONS (last updated: 24 February 2022)

Users shopping on madeingift.com accept these General Contract Terms and Conditions in their entirety. The user is obliged to read and accept them. Madeingift.com reserves the right to modify the General Contractual Conditions at any time and without prior notice. The prices and conditions of sale are informative only and may be modified according to the fluctuations of the market.

DELIVERY

Customers can choose between different delivery options and delivery times. We cannot 100% guarantee these delivery times as they depend on a third party.

The customer has 72 hours to check that all the components of the order are complete and that everything that should be included is included. Once these 72 hours have expired, the shipment will be considered accepted, and no complaints will be accepted for any damage or defects to the shipment.

In the event of a defective, incorrect or incomplete product, any complaint must be addressed to our customer service team. If we proceed to its repetition, Madeingift.com carries it out as soon as possible.

The shipment will be delivered to the address indicated as the destination. It will be deemed to have been carried out when the person at that address accepts to collect the shipment.

It is the customer's responsibility to provide correct details for delivery (names, addresses, postcodes, telephone numbers).

Shipping costs are calculated according to the place and date of the delivery as well as the type of shipping option you have chosen. In any case, the customer sees the data clearly during the purchase process and always before the payment.

Along with the items, the customer has the option to add a personal message for the recipient. The Souvenir Card is a product with no commercial value that we add with the best intentions, but in case of damage or loss will not be subject to any claims.

RIGHT OF WITHDRAWAL

In accordance with current legislation, you may withdraw from the contract within 14 calendar days of receiving the goods, without having to justify such a decision and without incurring any penalty. To do this, you must send us the product(s) after informing us of your decision to exercise your right of withdrawal. Once we have received the product(s), we will refund you the amount according to the payment method you used.

Your right of withdrawal shall not apply to contracts relating to:



- The supply of goods made or clearly personalised according to the specifications of the consumer and user

. - The supply of perishable goods that may spoil or expire quickly.

- The supply of sealed goods which are not suitable for return on health or hygiene grounds, and which have been unsealed after delivery.

Furthermore, please note:

The items must be returned in the original condition and packaging with any security seals intact. We reserve the right to decline the return of the package, if the item is not in its original condition.

The return will be at the customer's expense and must be in the same protective packaging in which they received the product. If it is not available, the customer must return it in similar protective packaging so that it reaches us in perfect condition.

RETURNS AND REFUNDS

All goods must be returned in their original packaging and in perfect condition and protected. Avoid stickers, seals or adhesive strips directly on the surface or packaging of the item. Otherwise, Madeingift.com reserves the right to refuse the return.

Once your return request has been accepted, you will receive instructions on how to send the product to our office. You must return the goods to us without delay and in any event within 14 calendar days of the day on which you informed us that you wish to exercise this right.

You will bear the transport costs for returning the goods. You can choose the delivery service which best suits your needs or offers you the cheapest rates.

Once we have received the goods and checked that they are in perfect condition, we will process the refund. We will refund the payment received, including delivery costs, with the exception of any additional costs incurred as a result of you choosing a shipping method other than the cheapest standard shipping method offered by us.

Personalised products are manufactured with the image and/or text sent by the user in the same position, quality, resolution and size. The user is responsible for ensuring that the image or text sent at the time of ordering meets the appropriate requirements for correct production. If you have any questions about the minimum requirements, please contact us.

Madeingift.com accepts no responsibility for any differences in colour or resolution between the original image and the product supplied due to poor quality of the original image file. Complaints due to subjective aesthetic preferences are no grounds for return.

Madeingift.com reserves the right to refuse the return if an anomaly is found on the returned product.

CANCELLATIONS

The customer has the option to request cancellation of an order if it has not yet been dispatched. If it has already left our premises, the request for cancellation will be treated as a right of withdrawal, and the conditions stipulated in the alleged article will apply.

In the case of products made or clearly personalised according to the specifications of the consumer and user, cancellation will not be accepted if they have already been manufactured, even if they have not yet been shipped.

DISCLAIMER

The company shall not be liable for incidents or delays in shipment due to force majeure and any acts or omissions beyond its control (such as weather, strikes, labour disputes, civil disturbances, acts of war, acts of terrorism and other similar circumstances).

TRADEMARK AND COPYRIGHT

The entire content of Madeingift.com (from texts to photos, logos, designs, buttons, files, web code, etc.) is protected by intellectual and industrial property laws. The total or partial reproduction of this content is prohibited without the written authorisation of the company, including but not limited to changing, publishing, renting, licensing, selling or distributing.

INTELLECTUAL PROPERTY RIGHTS

The user is responsible for the content of the images he/she sends for the creation of personalised gifts and represents that he/she is the sole owner of all rights that exist in the images he/she sends. The user also guarantees that he/she does not violate the rights of third parties to the persons or objects depicted in the photos.

GUARANTEES

In general, the warranty period is 2 years from the date of purchase. For this, it is essential to have the proof of purchase, which serves as proof to the user that the product was purchased in a shop and that the date of purchase is written on it. In the case of Madeingift.com, the purchase confirmation email.

The warranty does not cover defects caused by improper use of the product and/or handling other than that necessary to establish the nature, characteristics or functioning of the product. In such cases, the consumer is responsible for repairing the product. The following are, therefore, excluded from the guarantee:

-Defects and deterioration caused by external influences, accidents, wear and tear and use not in accordance with Madeingift.com's instructions.

- Products that have been modified or repaired by the customer or another person not authorised by Madeingift.com, as well as products that are the subject of a special support contract.

DISPUTE RESOLUTION/JURISDICTION

REGULATION (EU) No 524/2013 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL on online dispute resolution for consumer disputes and amending Regulation (EC). Defects caused by negligence, shock, improper use or manipulation, use of force or materials subject to natural wear and tear are not included.
Due to the customised nature of the products and in accordance with Article 45 of Act No. 7/1996 of 15 January on Retail Trade, there is no right of return for products delivered in perfect condition according to the customer's specifications. The customer who has made purchases via the Internet has a period of 14 working days to withdraw and return an item that has not met his or her expectations at the time of delivery (Article L. 121-16 et seq. of the Consumer Code). The formalities for returning these goods are written in the general conditions of sale established by the supplier, which may thus provide that these diversion costs are borne by the buyer.
